The terms that govern access to and use of Agents4DevOps.

These Terms of Service (the “Terms”) form a binding agreement between you and Modern Requirements (“we,” “us,” or “our”) governing your access to and use of the Agents4DevOps service (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you are entering into these Terms on behalf of an organisation, you represent that you have authority to bind that organisation.
Capitalised terms used in these Terms have the meanings given where they first appear. “Customer Data” means data submitted to or processed by the Service on your behalf. “Documentation” means the usage materials we make available for the Service. Additional definitions may be set out in an applicable order form or agreement.
You are responsible for maintaining the confidentiality of account credentials and for all activity under your account. You must provide accurate registration information and keep it current. Access is granted to authorised users only, and you are responsible for their compliance with these Terms.
You agree not to misuse the Service, including by attempting to gain unauthorised access, interfering with its operation, reverse engineering it except as permitted by law, using it to violate the rights of others, or using it in breach of applicable law. We may suspend access where use threatens the security or integrity of the Service.
Access to the Service is provided under the plan and credit model described in the applicable order form or pricing materials. Fees are billed as set out in that documentation. Unless stated otherwise, fees are non-refundable and exclusive of taxes.
We may offer trial or evaluation access. Trials are provided on an as-is basis, may be subject to usage limits, and may be modified or discontinued at our discretion. Any configuration or data associated with a trial may be deleted at the end of the trial period.
We and our licensors retain all rights, title, and interest in and to the Service, including all related intellectual property. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Service during the term. No rights are granted except as expressly set out here.
You retain your rights in Customer Data and are responsible for its accuracy, legality, and your right to submit it. You grant us the rights necessary to process Customer Data to provide the Service. You are responsible for configuring the Service, including approval boundaries and permissions, appropriately for your use.
Except as expressly stated, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Each party's aggregate liability arising out of or related to these Terms is limited as set out in the applicable agreement. [VERIFY] liability caps and exclusions with counsel.
These Terms remain in effect for the applicable subscription term. Either party may terminate for material breach that remains uncured after written notice. Upon termination, your right to access the Service ceases, and we may delete Customer Data in accordance with our retention practices, subject to applicable law.
These Terms are governed by the laws, without regard to its conflict of laws principles. The parties submit to the exclusive jurisdiction of the courts for the resolution of disputes, except where applicable law provides otherwise.
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
